Effective Date: March 6, 2026
This End User License Agreement (“Agreement”) is between Rocket Data Limited (“Licensor,” “we,” “us,” or “our”) and the person or entity downloading, installing, or using nextSurf (Android) (the “App”) (“you” or “User”).
This Agreement applies to all versions of the App distributed by Licensor through Google Play, including updates, upgrades, features, content, and related services, unless replaced by a newer version of this Agreement.
By downloading, installing, or using the App, you agree to this Agreement.
1. License Grant
Licensor grants you a limited, non-exclusive, worldwide, perpetual, non-transferable, non-sublicensable license to download, install, and use the App on Android devices you own or control, solely for personal, lawful use, in accordance with this Agreement, Google Play terms, and applicable law.
This is a license, not a sale. All rights not expressly granted are reserved.
2. License Restrictions
Except where prohibited by law, you may not:
Copy, modify, adapt, translate, or create derivative works of the App.
Reverse engineer, decompile, disassemble, or attempt to derive source code.
Remove or alter proprietary notices.
Rent, lease, lend, sell, sublicense, assign, distribute, or transfer the App.
Use the App to violate law, infringe rights, or build a competing product.
Circumvent technical protections or security controls.
3. Intellectual Property
The App and all related intellectual property rights are owned by Rocket Data Limited and its licensors. No ownership rights are transferred to you.
4. Data and Privacy
Your use of the App is subject to Licensor’s Privacy Policy:

You agree Licensor may process technical, diagnostic, and usage data as described there and as permitted by law.
5. Third-Party Services
The App may use or link to third-party services, data, or websites. Licensor is not responsible for third-party services and does not guarantee their accuracy, availability, or performance.
6. Updates and Changes
Licensor may provide updates, patches, or feature changes at any time. Features may be modified, suspended, or discontinued without liability to the extent permitted by law.
7. Termination
This Agreement remains effective until terminated. To the extent permitted by law, your rights under this Agreement may terminate automatically if you materially breach it. On termination, you must stop using and delete the App.
8. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR BUSINESS.
LICENSOR’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP WILL NOT EXCEED THE GREATER OF: (A) AMOUNTS PAID BY YOU FOR THE APP IN THE PRIOR 12 MONTHS, OR (B) USD $50.
10. Export and Compliance
You agree to comply with applicable export control and sanctions laws and not use or transfer the App in violation of those laws.
11. Governing Law and Jurisdiction
This Agreement is governed by the laws of New Zealand, excluding conflict-of-law rules. You and Rocket Data Limited submit to the non-exclusive jurisdiction of the courts of New Zealand, except where mandatory law in your country of residence provides otherwise.
12. Consumer Rights
Nothing in this Agreement limits or excludes any non-waivable rights or remedies you may have under applicable consumer protection laws.
13. Google Play Terms
This Agreement is between you and Rocket Data Limited, not Google. Google is not responsible for the App or its support. To the extent any term of this Agreement conflicts with the Google Play Developer Distribution Agreement or other applicable Google Play terms, those terms control to the extent of the conflict.
